Terms & Conditions

These are the terms and conditions by which we do business. They govern the relationship between you the customer and us the vendor. When you buy from us, you accept them.

1 Definitions

In this agreement: “Customer” means any individual or body corporate purchasing goods from us the vendor. “Carrier” is person or business who carries goods from us to you. “Our Web Site” refers to “jmsart.co.uk” and any software installation installed by us to support the site. “Goods” means any of the Goods we offer for sale on our web site “Vendor” means jmsart.co.uk.

2 The contract

2.1 Goods advertised or displayed on our website are invitations to treat. 2.2 We shall accept your order by e-mail confirming details of your purchase and its delivery. Delivery tracking information will be supplied where appropriate. 2.3 The terms that apply to you are those displayed on our web site on the day you treat. 2.5 All descriptions, weights and sizes of Goods shall not form part of this agreement. They are approximations and may not be relied upon.

3 Payment

3.1 The full price of your order is payable prior to despatch. 3.2 Title to Goods will remain the vendors until payment is made.

4 Delivery

4.1 Delivery will be made to the address you provide in your order. It is your responsibility to be present to accept delivery. 4.2 The cost of delivery will be quoted at the time your order is placed and is additional to the price of the goods.

5 Orders from outside The British Isles

5.1 We are willing to arrange delivery to countries outside the UK and Eire where possible but a quotation for delivery must be made prior to placing your order and is an additional, chargeable cost.

6 Returns and refunds

This agreement may be subject to the Distance Selling Regulations, by which may have a right of cancellation. If that is the case these terms shall apply: 6.1 The customer may cancel within 14 days of your receipt of the Goods. 6.2 The Goods must be returned to ourselves within 21 days of delivery: with both goods and packaging in their original saleable condition. Returns must therefore be securely packaged 6.3 The risk and cost of returning goods shall be with the customer 6.4 When the returned goods are received the full purchase price of the goods shall be credited to the originating “paypal” account no later than 30 days from the date of receipt;

7 Disclaimers

7.1 Links to other Internet web sites from our website are provided for customers’ use only with the recognition that we have no control over any such web sites’ content. You the customer, therefore agrees that we shall not be liable in any way for the Content of any such linked site. Neither shall we be liable for any loss or damage arising from your use of any such web site. 7.2 We are not liable in any circumstances for your use of Our Web Site or the purchase of Goods. 7.3 In the event of a judicial body having competence over our contract in respect of any claim that you the customer may make, our liability is limited to the value of the goods you have purchased.

8 Indemnity

You agree to indemnify us against any claim for damages or fees, made by any third party due to or arising in any way out of your use of Our Web Site.

9 Force majeure

We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

10 Governing Law

This Agreement shall be governed by and construed in accordance with the law of England.
